General Terms
Lead time will be finalised at the time of order. Warringah Plastics will not be responsible for customer delays in providing information or not being communicable.
Once a project enters production any changes to a part including drawing changes or project scope changes, the customer will be financially responsible for any lost materials, labour and overheads and any additional time in the re-work or re-tooling of the project.
For large or expensive mass production runs we will often manufacture a first off sample. This is produced for your convenience so you can try out and assess a part before it enters mass production. You should indicate any changes you would like to make immediately to your Warringah Plastics account manager. This should be done before a part enters mass production. An approved first off sample will be what is mass produced so therefore if a customer approves a first off sample but rejects the mass production run but the mass production run matches the sample the client will be responsible in full for any rework required including material, labour and any other overheads required to re-produce the parts. Although we will take all due diligence to ensure our first off sample matches the customers requirements or engineering drawings it is ultimately the customer that is responsible that the first off sample is correct for their application.
In line with industry standards up to 5% over or unders will be charged or deducted accordingly. Any date quoted for delivery both in writing or otherwise is an estimate unless a guarantee is given in writing by Warringah Plastics. The customer shall accept and pay for goods notwithstanding any failure by Warringah Plastics to deliver by the quoted date. Shall the customer have specific availability to receive items or goods they must inform Warringah Plastics in writing. Warringah Plastics will not be liable to any customer or to any other party for any loss or damage including direct or indirect or consequential injury or damage whatsoever due to delay in delivery, redelivery or negligence of Warringah Plastics or actions which result in a breach of contract, strike, industrial action or any other cause whatsoever.
Warringah Plastics reserves the right to deliver in instalments and if delivery is made in instalments the customer shall not be entitled to terminate or cancel the contract.
Payment terms are COD or nett 30 days for Account Customers. Prices exclude GST and delivery (unless delivery is quoted as a separate line item). In the event of non-payment of a Warringah Plastics invoice, Warringah Plastics reserves the right to commence collection action and withhold the delivery of goods and services to the customer. If Warringah Plastics is required to employ the services of a debt collector to pursue an overdue payment, a $300 administration fee will be passed on to the customer and added to the customer’s outstanding balance. The customer will be responsible for the costs associated with the collection of invoiced amounts including legal costs, court and tribunal fees, solicitor costs and expenses, witness expenses, barrister’s fees, expert witness fees, adjudicator’s expenses and any other expense. The customer agrees that these expenses are not a penalty but an amount Warringah Plastics is liable to pay in such circumstances.
Notwithstanding the delivery of goods or part thereof, the goods remain the sole and absolute property of Warringah Plastics. Warringah Plastics will be a full legal and equitable owner of products until Warringah Plastics has received payment in full and any other outstanding balances or contractual obligations have been fulfilled by the customer. If the customer is in possession of goods owned by Warringah Plastics the owner will store the items separately on their premises, in a safe and secure location. The customer must have insurance for these items against any such risks.
Any designs or engineering drawings submitted to Warringah Plastics will always be the ownership of the customer. Any designs, inventions, methods and techniques utilised by Warringah Plastics for a concept design, prototype or manufactured product, including making it suitable for manufacturing are the intellectual property of Warringah Plastics. Warringah Plastics has the right to enforce its intellectual property when being stolen, replicated or imitated by local or overseas manufacturers.
Any quote provided by Warringah Plastics is not an offer to sell or provide goods and services to the customer. Warringah Plastics will not be bound by any order outlined in a quotation until it is either accepted by Warringah Plastics in writing or by the commencement to supply goods and services. All orders are subject to being accepted by Warringah Plastics within 30 days of receipt of the order.
Warringah Plastics will not be liable under any circumstance due to defects or damages caused by misuse, abuse, neglect, electrical overload, non-suitable accessories or components, improper installation, repair or alteration to our products. Warringah Plastics is not responsible for goods not manufactured by Warringah Plastics. Warringah Plastics has the right to refuse to accept goods because of a customer’s change of mind. In instances where Warringah Plastics agrees to accept returned goods, there will be a 15% restock fee payable by the customer.
To help advertise our products and capabilities Warringah Plastics may use designs or even concept designs generated by us or photographs of your final product or your product in manufacturing on our website and other advertising material. If you wish for your project not to be used in any advertising material a non-disclosure agreement must be presented to Warringah Plastics before the project begins.
If Warringah Plastics is contracted to provide a prototype or design concept to a customer and the customer doesn’t pursue a manufacturing order the customer is liable to pay for our design and prototyping services. These fees include our design hourly rate of $80 per an hour and the job setup, labour, materials and overhead required to produce any samples or prototypes. The customer will be invoiced after 30 days after the completion of such products and services.
All quotes and prices listed by Warringah Plastics are valid for 30 days.
It is the customer’s responsibility to keep Warringah Plastics informed with their up to date contact information. Warringah Plastics will not be held financially responsible for any additional work, loss of time or quality if the customer is not contactable or provides misinformation.
Warringah Plastics reserves the right to refuse service or access to its products and services to anyone if these terms are breached at any time throughout the project. These terms will be governed by the laws of New South Whales. The parties are to irrevocably submit to the non-exclusive jurisdiction of the courts of New South Whales.

DELIVERY REGIONS
We deliver to most addresses around Australia, but unfortunately at this point in time we do not deliver to internationally. We require a standard street address for delivery; we don’t delivery to P.O. Box locations. Unfortunately some remote locations particularly in rural areas cannot be serviced, however if this the case we can often deliver to a local pickup station/depot where you can collect the product(s). The locations we deliver to may change over time. Please call us if you would like to specifically know whether we can delivery to your area.
DELIVERY TIMES
All deliveries are made 7:30AM to 5:00PM Monday to Friday by our chosen carrier. Please allow a 1-2 days for packing and handling. We will not begin this packing and handling process until the product(s) have been paid for in full. Delivery times can vary from location to location so please use the below information as an indication on delivery time:

During peak periods like Christmas and Easter delivery time may be extended by 5-10 working days. Please note that these delivery times are estimates only, and actual delivery times may vary. The courier might attempt to contact you to arrange a delivery time using the contact details you provide online during checkout. We are not responsible for any late delivery or failure to deliver due to circumstances beyond our reasonable control.
Please ensure that your requested delivery location is free from obstructions and is otherwise in a clean and tidy state to prevent any delivery delays. At the time of delivery, you will be asked to sign a form to acknowledge that the goods were delivered in good and proper condition. Where you have requested that a representative will accept delivery of the goods on your behalf, we will require acknowledgment from your representative. Please note that our contracted couriers are under strict instructions to only deliver to an authorised representative to receive your Hard Top trailer cover.
DELIVERY COST
Delivery charges are calculated on a per order basis according to the weight and volume of the product and your designated delivery address. Whilst on a cart or checkout page on our website you will be prompted to enter your postcode so a quote can be generated to deliver the goods. If we find that this amount might have been generated incorrectly we will contact you and either arrange a full refund or re-quote the delivery for you. If a courier contacts you to arrange delivery and you or a designated representative is not present at the location at the designated time you may be charged a re-delivery fee. Hard Top is not responsible for this delivery fee.
DELIVERY ACCEPTANCE
Deliveries must be signed for, and anyone at the delivery address who receives the product(s) shall be presumed by Warringah Plastics to be authorized to receive the products. Please note that risk for loss or damaged products passes to the customer upon delivery of the product(s) by the courier.
DELIVERY PROBLEMS
If your delivery has not arrived, please contact us using the information stated at the top of this policy. If you wish to return a product delivered damaged or otherwise, please refer to our Returns Policy.
YOUR RIGHTS AS A CONSUMER
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
OUR TERMS AND CONDITIONS
If you find that your product(s) have a manufacturing fault or doesn’t function as advertised we will happily repair the product(s) within 6 months of purchase. If we are unable to repair the product(s) we will then issue you a replacement followed by a full refund. If the product has a fault after this 6 month period any repair work will be charged and if a refund is necessary it will be pro-rata. Any maintenance required for the product(s) like cleaning or refitting hinges is the customers responsibility. We expect customers to care and use our products in a safe manner at all times. If we believe a product has been miss-used or if any damage has occurred that is not related to manufacturing we are not obliged to issue a replacement or refund.

However Warringah Plastics may be required by law to disclose information to government authorities. Another exception is a request by the customer to contact 3rd parties e.g. a credit card organisation, on their behalf for the customers convenience. All online transactions take place on a HTTPS connection or a secure encrypted connection on both ends. Warringah Plastics is not responsible for the security of data that is stored or processed by third party payment gateways like Paypal.
